The basics of personal injury damages and no-fault insurance in New Jersey

A person who is injured by the negligence of someone else in New Jersey may have the right to file a personal injury lawsuit to obtain compensation (also called damages). However, New Jersey has a comparative negligence law that prevents recovery of damages by a person found to be 50 percent or more responsible for the underlying incident. Moreover, an injured party’s recovery will be reduced by their own percentage of fault.
